Susan, Home Buyer in 60622

We are purchasing an "estate sale" home. It is full of items. Do we have to hold the items for x amount of days after we take possession?

We have Gen Contractors to start paint/carpet/etc 7 days after we get keys. We want to donate, keep and sell the items in there, then trash out remaining and have Contractors start ASAP. No one knows if we have to "hold" the items for a certain period of time before we can get rid of them. This is in the state of Washington...I have no clue what to do! Thank you!

I would still talk to my attorney. We agents in Illinois have no idea how it works in Washington. You may legally be required to do a personal property eviction. Check with a real estate attorney in Washington.

Hi Susan,

It's all been said...once you close on the house it and all it's belongings are yours, unless there was an agreement stating otherwise.

Ask your attorney.

I agree with Bill this should be in your real estate contract. If in doubt you should consult the attorney that handled your transaction. Good luck.

Check your purchase contract. However, if the contract doesn't specify that some or all of the possessions didn't convey, then it's yours. [What do you mean "No one knows"?] Your Realtor doesn't know? If not, speak to your agent's broker.

No, when you closed the possession should have been cleaned out. I would have your attorney notify the seller's attorney that an order to the sellers to remove their possessions or the items will be removed

The seller's attorney and real estate agent should know what to do. The property and all the personal items within are technically supposed to be yours the day of the closing and forward... at least in Illinois.

I do not know about Washington, but in Illinois once you close on the property anything in the home is yours. You are free to do what you would like with it. This is just like the appliances. Since it is Washington, I would consult with a local real estate attorney. I wouldn't worry about it too much. I would think the family would have taken anything worth taking.

This info should be in the purchase contract as to whether all the personal items will be included in the home as well. Usually, whatever is in the house at the time of closing (unless a prior agreement exists) belongs to the buyer.

Ask your attorney that is handling the closing. But I would say no.
