An escrow account would be a good means to resolcve the conflict. I would want the escrow at my Attorney's office if this were the case. You can never be to careful.

If you are the tenant, offering the entire lease amount in advance in exchange for:
1) less than perfect credit; or
2) a reduction in the total amount of rent,
there is nothing wrong with such a scheme.
If the landlord is demanding this.... buyer beware!
Make sure you check that the landlord:
1) Owns the property/has the right to lease the property.
2) Does not have foreclosure proceedings underway (Lis pendens)
3) Does not owe significant back Homeowners association dues (HOA)
4) Does not owe back taxes.
I do all of the above for my tenants...which is why it may be smart to do your rental through a Realtor.s

All the answers below are great. From my experience, make sure you look at the property carefully and make all your demands before signing the lease. Find out exactly who will you have to contact if something goes wrong in the home, find out what the rules and regulations are before you get yourself in trouble. Know exactly what the landlord will pay and what you will have to pay and make sure you respect the requested general maintenance requirements.... more
